END USER LICENSE AGREEMENT (EULA) FOR GPS LAND AREA MEASURE

This End User License Agreement ("EULA" or "Agreement") is a legal contract 

between you ("End User", "Licensee", or "you") and GPS Land Area Measure Team 

("Licensor", "Developer", "we", "us", or "our"), governing your use of the 

GPS Land Area Measure mobile application for iOS, including any updates, 

documentation, or online components (the "Licensed Application").


BY DOWNLOADING, INSTALLING, COPYING, OR USING THE LICENSED APPLICATION FROM 

THE APPLE APP STORE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. 

IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT DOWNLOAD, INSTALL, 

OR USE THE LICENSED APPLICATION.

1. ACKNOWLEDGEMENT

Licensor and you acknowledge that this Agreement is concluded between Licensor 

and you only, and not with Apple Inc. ("Apple"). Licensor, and not Apple, is 

solely responsible for the Licensed Application and the content thereof. This 

Agreement incorporates by reference the terms of Apple's Standard Licensed 

Application End User License Agreement as set forth in Apple Media Services 

Terms and Conditions.

2. SCOPE OF LICENSE

1. Grant of License: Licensor grants you a revocable, non-exclusive, 

   non-transferable, non-sublicensable, limited license to install and use the 

   Licensed Application on any Apple-branded products (iPhone, iPad) that you 

   own or control, strictly as permitted by the Usage Rules set forth in the 

   Apple Media Services Terms and Conditions.


2. Family Sharing: This license also permits the Licensed Application to be 

   accessed and used by other accounts associated with you via Apple Family 

   Sharing or volume purchasing programs where permitted by Apple.


3. Restrictions: You may not:

   - Rent, lease, lend, sell, redistribute, or sublicense the Licensed 

     Application.

   - Decompile, reverse engineer, disassemble, attempt to derive the source 

     code of, modify, or create derivative works of the Licensed Application, 

     any updates, or any part thereof.

   - Use the Licensed Application for any purpose prohibited by applicable 

     local, state, national, or international laws.

3. GEODESIC & NON-CERTIFIED SURVEYING ADVISORY

- The Licensed Application performs mathematical calculations of geographic 

  area, distance, perimeter, and elevation based on GPS receiver coordinates, 

  compass headings, and Apple MapKit satellite imagery.

- THE APPLICATION DOES NOT PROVIDE CERTIFIED LAND SURVEYS.

- Calculations are for personal, landscaping, agricultural, sports planning, 

  estimation, and informational reference only.

- Licensor makes no warranty regarding legal boundary determination, title deed 

  compliance, or property conflict resolution. You agree not to rely on the 

  Licensed Application for legal, engineering, or structural construction 

  boundary verifications without consulting a certified, licensed surveyor.

4. MAINTENANCE AND SUPPORT

Licensor is solely responsible for providing any maintenance and support 

services with respect to the Licensed Application, as specified in this 

Agreement or as required under applicable law. You and Licensor acknowledge that 

Apple has no obligation whatsoever to furnish any maintenance and support 

services with respect to the Licensed Application.

5. IN-APP SUBSCRIPTIONS AND PURCHASES

1. Auto-Renewing Subscriptions: If you subscribe to premium features in the 

   Licensed Application, payment will be charged to your Apple ID account at 

   confirmation of purchase.

2. Auto-Renewal: Subscriptions automatically renew unless auto-renew is 

   canceled at least 24 hours prior to the end of the current period.

3. Management: You may manage or cancel subscriptions in your Apple ID 

   Account Settings at any time.

4. Billing: All billing, cancellations, and renewals are administered directly 

   by Apple under Apple's Media Services Terms and Conditions.

6. WARRANTY DISCLAIMER

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT 

YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED 

APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION 

ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY 

OF ANY KIND.


LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE 

LICENSED APPLICATION, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT 

LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF 

SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY OF 

MAP/GPS POSITIONING, OF QUIET ENJOYMENT, AND OF NON-INFRINGEMENT OF THIRD-PARTY 

RIGHTS.


APPLE WARRANTY NOTICE: In the event of any failure of the Licensed Application 

to conform to any applicable warranty, you may notify Apple, and Apple will 

refund the purchase price for the Licensed Application to you (if applicable). 

To the maximum extent permitted by applicable law, Apple will have no other 

warranty obligation whatsoever with respect to the Licensed Application, and 

any other claims, losses, liabilities, damages, costs, or expenses attributable 

to any failure to conform to any warranty will be Licensor's sole responsibility.

7. PRODUCT CLAIMS

--------------------------------------------------------------------------------


You and Licensor acknowledge that Licensor, not Apple, is responsible for 

addressing any claims of the End User or any third party relating to the 

Licensed Application or the End User's possession and/or use of that Licensed 

Application, including, but not limited to:

1. Product liability claims;

2. Any claim that the Licensed Application fails to conform to any applicable 

   legal or regulatory requirement; and

3. Claims arising under consumer protection, privacy, or similar legislation.

8. INTELLECTUAL PROPERTY RIGHTS

You and Licensor acknowledge that, in the event of any third-party claim that 

the Licensed Application or the End User's possession and use of that Licensed 

Application infringes that third party's intellectual property rights, Licensor, 

not Apple, will be solely responsible for the investigation, defense, 

settlement, and discharge of any such intellectual property infringement claim.

9. LEGAL COMPLIANCE & EXPORT REGULATIONS

You represent and warrant that:

1. You are not located in a country that is subject to a U.S. Government 

   embargo, or that has been designated by the U.S. Government as a "terrorist 

   supporting" country; and

2. You are not listed on any U.S. Government list of prohibited or restricted 

   parties.

10. THIRD-PARTY TERMS OF AGREEMENT

--------------------------------------------------------------------------------


You must comply with applicable third-party terms of agreement when using the 

Licensed Application (e.g., you must not be in violation of your wireless data 

service agreement or cellular carrier contract when utilizing live GPS tracking 

and map loading features).

11. THIRD-PARTY BENEFICIARY

--------------------------------------------------------------------------------


You and Licensor acknowledge and agree that Apple, and Apple's subsidiaries, 

are third-party beneficiaries of this Agreement, and that, upon your acceptance 

of the terms and conditions of this Agreement, Apple will have the right (and 

will be deemed to have accepted the right) to enforce this Agreement against 

you as a third-party beneficiary thereof.

12. TERMINATION

--------------------------------------------------------------------------------


The license is effective until terminated by you or by Licensor. Your rights 

under this license will terminate automatically without notice from Licensor if 

you fail to comply with any term(s) of this Agreement. Upon termination of the 

license, you shall cease all use of the Licensed Application and destroy all 

copies, full or partial, of the Licensed Application.
